{"id":24217,"date":"2023-10-16T10:37:16","date_gmt":"2023-10-16T10:37:16","guid":{"rendered":"https:\/\/rideoutlaw.com\/?p=24217"},"modified":"2025-11-04T16:40:21","modified_gmt":"2025-11-04T23:40:21","slug":"bench-warrant-arizona","status":"publish","type":"post","link":"https:\/\/rideoutlaw.com\/es\/bench-warrant-arizona\/","title":{"rendered":"Bench Warrants in Arizona"},"content":{"rendered":"<h2><strong>Bench Warrants in Arizona<\/strong><\/h2>\n<p>In Arizona, a bench warrant can be issued by a judge, magistrate, commissioner, or justice of the peace when a defendant:<\/p>\n<ul>\n<li>doesn\u2019t show up for a scheduled court hearing (\u201c<a href=\"https:\/\/rideoutlaw.com\/failure-to-appear\/\">Failure to Appear<\/a>\u201d).<\/li>\n<li>doesn\u2019t comply with a court-mandated order.<\/li>\n<li>violates a term of their probation.<\/li>\n<li>fails to pay court-ordered restitution.<\/li>\n<\/ul>\n<p>A bench warrant allows a law enforcement officer to arrest the defendant. Police are able to come to the defendant\u2019s residence, workplace, or anywhere else to make the arrest. As such, anyone who knows they have an active bench warrant should turn themself in rather than being arrested. After arrest or turning themself in, the defendant will meet with a judicial officer within 24 hours where their conditions for release will be considered.<\/p>\n<p>A bench warrant remains valid until the defendant appears before the court that issued the warrant and is heard on that case.<\/p>\n<p>To find out if you have an active warrant, visit this article: <a href=\"https:\/\/rideoutlaw.com\/active-warrant-search-arizona\/\">How to Look Up an Active Warrant<\/a><\/p>\n<p>If your bench warrant is for Failure to Appear, your warrant will be on of these two options:<\/p>\n<ul>\n<li><strong>Failure to Appear in the First Degree<\/strong> (<a href=\"https:\/\/www.azleg.gov\/ars\/13\/02507.htm#:~:text=13%2D2507%20%2D%20Failure%20to%20appear%20in%20the%20first%20degree%3B%20classification&amp;text=A.,the%20charge%20requiring%20the%20appearance.\">A.R.S. 13-2507<\/a>) \u2013 This is issued for failing to appear for a court hearing regarding a felony charge. This violation is itself a class 5 felony, which can result in penalties up to and including six months to two and a half years in prison.<\/li>\n<li><strong>Failure to Appear in the Second Degree<\/strong> (<a href=\"https:\/\/www.azleg.gov\/ars\/13\/02506.htm\">A.R.S. 13-2506<\/a>) \u2013 This is issued to for failing to appear for a court hearing regarding a misdemeanor or petty offense.
