{"id":24659,"date":"2023-11-18T10:19:21","date_gmt":"2023-11-18T10:19:21","guid":{"rendered":"https:\/\/rideoutlaw.com\/?p=24659"},"modified":"2023-12-14T20:45:09","modified_gmt":"2023-12-14T20:45:09","slug":"drive-by-shooting-laws","status":"publish","type":"post","link":"https:\/\/rideoutlaw.com\/es\/drive-by-shooting-laws\/","title":{"rendered":"Drive-By Shooting Laws: A.R.S. 13-1209"},"content":{"rendered":"<h2 style=\"text-align: center;\"><strong>Drive-By Shooting Laws<\/strong><\/h2>\n<p>As written in <a href=\"https:\/\/www.azleg.gov\/ars\/13\/01209.htm\">A.R.S. 13-1209<\/a>, a person commits drive-by shooting by intentionally discharging a weapon from a motor vehicle at a person, another occupied motor vehicle, or at an occupied structure. The law does not require the offender to actually strike a victim with a bullet in order to be charged.<\/p>\n<p>Drive-by shooting is a class 2 felony, for which first-time offenders can be sentenced to up to 12.5 years of incarceration.<\/p>\n<p>In addition, the offender must surrender their driver\u2019s license to be invalidated or destroyed. By court order, the offender will also have their driving privileges revoked for a period of at least one year and, at most, five years as ordered by the judge. The motor vehicle used in the drive-by shooting event will be subject to forfeiture.<\/p>\n<p>Offenders of drive-by shooting can be charged with additional crimes related to the drive-by shooting offense. In September 2023, a Goodyear woman was arrested for a drive-by shooting charge at a local Wal-Mart, <a href=\"https:\/\/www.azcentral.com\/story\/news\/local\/southwest-valley\/2023\/09\/25\/woman-arrested-in-connection-with-goodyear-drive-by-shooting\/70966637007\/\">as reported by Abigail Celaya<\/a> of the Arizona Republic.
