It is often committed in conjunction with other crimes. Kidnapping offenses are taken seriously, with penalties varying based on the specific circumstances.<\/p>\n<p>As defined by <a href=\"https:\/\/www.azleg.gov\/ars\/13\/01304.htm\">A.R.S. 13-1304<\/a>, a person commits kidnapping by knowingly restraining another person with the intent to do any one of the following:<\/p>\n<ul>\n<li>Hold the victim for ransom or as a shield or hostage.<\/li>\n<li>Hold the victim for involuntary servitude.<\/li>\n<li>Inflict death, physical injury, or sexual offense on the victim, or to otherwise aid in the commission of a felony.<\/li>\n<li>Place the victim or a third person in reasonable apprehension of imminent physical injury to either of them.<\/li>\n<li>Interfere with the performance of a political or governmental function.<\/li>\n<li>Seize or exercise control over any airplane, train, bus, ship, or other vehicle.<\/li>\n<\/ul>\n<h3><strong>Kidnapping Penalties<\/strong><\/h3>\n<p><strong><em>Class 2 Felony<\/em><\/strong> \u2013 In the following situations:<\/p>\n<ul>\n<li><strong><em>Other than<\/em><\/strong> when the victim is released voluntarily by the defendant without physical injury in a safe place before arrest and before accomplishing any other kidnapping intentions as listed in the above statute.<\/li>\n<li>If the victim is under 15 years of age.<\/li>\n<\/ul>\n<p>First-time offenders can be sentenced to incarceration of up to 12.5 years. Additionally, the sentence for kidnapping a victim under age 15 runs consecutively to any other sentence imposed on the defendant and to any undischarged term of imprisonment of the defendant.<\/p>\n<p><strong><em>Class 3 Felony<\/em><\/strong> \u2013 In the following situation:<\/p>\n<ul>\n<li>If the victim is released pursuant to an agreement with the state and without physical injury.<\/li>\n<\/ul>\n<p>First-time offenders can be sentenced to incarceration of up to 8.75 years.<\/p>\n<p><strong><em>Class 4 Felony<\/em><\/strong> \u2013 In the following situation:<\/p>\n<ul>\n<li>When the victim is released voluntarily by the defendant without physical injury in a safe place before arrest and before accomplishing any other kidnapping intentions as listed in the above statute.<\/li>\n<\/ul>\n<p>First-time offenders can be sentenced to incarceration of up to 3.75 years.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Offenses Related to Kidnapping<\/strong><\/h3>\n<p>Kidnapping often occurs in combination with other offenses, including <a href=\"https:\/\/rideoutlaw.com\/unlawful-imprisonment\/\">unlawful imprisonment<\/a>, <a href=\"https:\/\/rideoutlaw.com\/sex-trafficking-prostitution\/\">sex trafficking<\/a>, <a href=\"https:\/\/rideoutlaw.com\/aggravated-assault-ars-131204\/\">aggravated assault<\/a>, and <a href=\"https:\/\/rideoutlaw.com\/custodial-interference\/\">custodial interference<\/a>.
