Anyone who is unable to afford hiring a private attorney will be provided with a court-appointed attorney.<\/p>\n<p>These court-appointed attorneys are known as public defenders. Appointed by the State of Arizona, these public defenders provide full legal representation at no cost to the defendant. All public defenders in Arizona have the following qualifications:<\/p>\n<ul>\n<li>Licensed attorneys in the State of Arizona<\/li>\n<li>Good standing with the Arizona State Bar<\/li>\n<\/ul>\n<p>Public defenders are available to defendants in the following Arizona cases:<\/p>\n<ul>\n<li>Superior court cases<\/li>\n<li>Justice court cases<\/li>\n<li>Extradition hearings<\/li>\n<li>Mental disorder\/health hearings<\/li>\n<li>Involuntary commitment hearings<\/li>\n<li>Juvenile delinquency cases<\/li>\n<li>Cases in which jail time is a possibility<\/li>\n<li>Appeals<\/li>\n<\/ul>\n<p>As stated in <a href=\"https:\/\/www.azleg.gov\/ars\/11\/00584.htm\">A.R.S. 11-584<\/a>, public defenders, on order of the court, defend, advise, and counsel any person who is entitled to counsel as a matter of law and who is not financially able to employ counsel in any of the types of cases listed above.<\/p>\n<h3><strong>Public Defenders in City Courts<\/strong><\/h3>\n<p>Eligible defendants who have criminal cases within city courts will also have public defenders available to them, as appointed by the city or municipality in which their case is being heard. Each city\u2019s public has their own guidelines regarding cost and eligibility. Cities typically contract with local, private attorneys to provide public defender services.<\/p>\n<p>The City of Phoenix may provide public defenders for free, or at reduced cost, to defendants charged with misdemeanor crimes for which they are facing jail time. The <a href=\"https:\/\/www.phoenix.gov\/publicdefender\">City of Phoenix Public Defender\u2019s Office<\/a> contracts both private attorneys and public employees.<\/p>\n<p>The City of Mesa reserves the right to determine eligibility for a public defender by a judge in the courtroom in conjunction with financial eligibility.
