Drugs labeled as \u201cdangerous\u201d by Arizona law include PCP, methamphetamine, anabolic steroids, acid, LSD, ecstasy, mushrooms, and amphetamines. A full listing of all dangerous drugs can be found in <a href=\"https:\/\/www.azleg.gov\/ars\/13\/03401.htm\">A.R.S. 13-3401<\/a>.<\/p>\n<p>Per <a href=\"https:\/\/www.azleg.gov\/ars\/13\/03407.htm\">A.R.S. 13-3407<\/a>, the possession, use, administration, sale, manufacture, and transportation of dangerous drugs are all felony crimes.<\/p>\n<h3><strong>Felony Class by Dangerous Drug Crime<\/strong><\/h3>\n<ol>\n<li><strong><em>Possession or use of a dangerous drug<\/em><\/strong> \u2013 Class 4 Felony<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>If the offender is a first-time offender, and the offense did not involve lysergic acid diethylamide, methamphetamine, amphetamine, or phencyclidine, the court may choose to convict instead for a class 1 misdemeanor.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong><em>Possession of a dangerous drug for sale<\/em><\/strong> \u2013 Class 2 Felony<\/li>\n<li><strong><em>Possession of equipment, chemicals, or both, for the purpose of manufacturing a dangerous drug<\/em><\/strong> \u2013 Class 3 Felony<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>If the offense involved methamphetamine, the offense is a class 2 felony.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong><em>Manufacturing a dangerous drug<\/em><\/strong> \u2013 Class 2 Felony<\/li>\n<li><strong><em>Administering a dangerous drug to another person<\/em><\/strong> \u2013 Class 2 Felony<\/li>\n<li><strong><em>Obtaining or procuring the administration of a dangerous drug by fraud, deceit, misrepresentation, or subterfuge<\/em><\/strong> \u2013 Class 3 Felony<\/li>\n<li><strong><em>Transporting for sale, importing into Arizona, offering to transport for sale, offering to import into Arizona, selling, transferring, or offering to sell or transport a dangerous drug (<\/em><\/strong><a href=\"https:\/\/rideoutlaw.com\/dangerous-drug-trafficking-a-r-s-13-3407\/\"><strong><em>Trafficking<\/em><\/strong><\/a><strong><em>)<\/em><\/strong> \u2013 Class 2 Felony<\/li>\n<\/ol>\n<h3><strong>Prison Ranges for Dangerous Drug Crimes<\/strong><\/h3>\n<p>First-time offenders may be incarcerated for up to the following lengths of time:<\/p>\n<p><strong><em>Class 1 Misdemeanor<\/em><\/strong> \u2013 Up to six months<\/p>\n<p><strong><em>Class 4 Felony<\/em><\/strong> \u2013 Up to 3.75 years<\/p>\n<p><strong><em>Class 3 Felony<\/em><\/strong> \u2013 Up to 8.75 years<\/p>\n<p><strong><em>Class 2 Felony<\/em><\/strong> \u2013 Up to 12.5 years<\/p>\n<h3><strong>Additional Considerations and Penalties<\/strong><\/h3>\n<p>Dangerous drug crimes can have additional considerations when it comes to prison lengths and penalties.<\/p>\n<p>If the <strong><em>aggregate amount<\/em><\/strong> of dangerous drugs involved in one, or all, of the offenses that are consolidated for trail equals or exceeds the statutory threshold for the drugs involved, the offender will not be eligible for suspension of sentence, probation, pardon or release from confinement on any basis until the person has served the sentence imposed by the court, the person is eligible for release pursuant to law, or the sentence is commuted. These thresholds include:<\/p>\n<p style=\"text-align: center;\"><strong><em>Methamphetamine \u2013 9 grams<\/em><\/strong><\/p>\n<p style=\"text-align: center;\"><strong><em>Amphetamine \u2013 9 grams<\/em><\/strong><\/p>\n<p style=\"text-align: center;\"><strong><em>Lysergic Acid Diethylamide \u2013 0.5 milliliters<\/em><\/strong><\/p>\n<p style=\"text-align: center;\"><strong><em>PCP \u2013 4 grams or 50 milliliters<\/em><\/strong><\/p>\n<p>If the crime was a violation of either 2, 3, 4, or 7, as listed above, and <strong><em>methamphetamine <\/em><\/strong>was involved, a first-time offender can be incarcerated for up to <strong><em>15 years<\/em><\/strong>.
