{"id":25284,"date":"2024-02-20T10:30:49","date_gmt":"2024-02-20T10:30:49","guid":{"rendered":"https:\/\/rideoutlaw.com\/?p=25284"},"modified":"2024-02-19T18:43:15","modified_gmt":"2024-02-19T18:43:15","slug":"can-a-passenger-in-a-vehicle-drink-alcohol","status":"publish","type":"post","link":"https:\/\/rideoutlaw.com\/es\/can-a-passenger-in-a-vehicle-drink-alcohol\/","title":{"rendered":"Can a Passenger in a Vehicle Drink Alcohol?"},"content":{"rendered":"<h2 style=\"text-align: center;\"><strong>Can a Passenger in a Vehicle Drink Alcohol?<\/strong><\/h2>\n<p>Arizona has strict \u201c<a href=\"https:\/\/rideoutlaw.com\/arizonas-open-container-laws\/\">open container laws<\/a>\u201d which make it illegal to have <strong><em>any<\/em><\/strong> open container of alcohol in a passenger area of a vehicle.<\/p>\n<p>According to <a href=\"https:\/\/www.azleg.gov\/ars\/4\/00251.htm\">A.R.S. 4-251<\/a>, the following is unlawful:<\/p>\n<ul>\n<li>Consuming spiritous liquor while operating, or <strong><em>while within<\/em><\/strong>, a motor vehicle located on any public highway, or its right-of-way, in the state of Arizona.<\/li>\n<li><strong><em>Possessing<\/em><\/strong> an open container of spiritous liquor within the passenger compartment of a motor vehicle located on any public highway, or its right-of-way, in the state of Arizona.<\/li>\n<\/ul>\n<p>As such, <strong><em>not even a passenger who is of legal drinking age, and who has no intention of getting behind the wheel, is permitted to drink alcohol or hold an opened container of alcohol. <\/em><\/strong>This applies even for passengers who are sitting in the back seat of a vehicle.<\/p>\n<p>Open containers are defined as any that have been opened, had its seal broken, or had its contents partially removed.
