It allows for individuals to be charged with driving under the influence with a blood-alcohol content level <em>under<\/em> the .08 mark. This is known as being \u201cimpaired to the slightest degree.\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.azleg.gov\/ars\/28\/01381.htm\">A.R.S. 28-1381<\/a>, a person may be impaired to the slightest degree while under the influence of:<\/p>\n<ul>\n<li>Intoxicating liquor.<\/li>\n<li>Any drug (including valid prescriptions).<\/li>\n<li>A vapor releasing substance containing a toxic substance.<\/li>\n<li>Any combination of liquor, drugs, or vapor-releasing substances.<\/li>\n<\/ul>\n<p>Law enforcement is able to enter an \u201cImpaired to the Slightest Degree\u201d charge without testing for BAC level since there is no mandated threshold for this charge.<\/p>\n<p>In a DUI trial, action, or proceedings, defendant&#8217;s alcohol concentration within two hours of the time of driving or being in actual physical control as shown by analysis of the defendant&#8217;s blood, breath, or other bodily substance gives rise to the following presumptions:<\/p>\n<ul>\n<li>If there was at that time 0.05 or less alcohol concentration in the defendant&#8217;s blood, breath, or other bodily substance, it may be presumed that the defendant was not under the influence of intoxicating liquor.<\/li>\n<li>If there was at that time in excess of 0.05 but less than 0.08 alcohol concentration in the defendant&#8217;s blood, breath or other bodily substance, that fact shall not give rise to a presumption that the defendant was or was not under the influence of intoxicating liquor, but that fact may be considered with other competent evidence in determining the guilt or innocence of the defendant.<\/li>\n<li>If there was at that time 0.08 or more alcohol concentration in the defendant&#8217;s blood, breath or other bodily substance, it may be presumed that the defendant was under the influence of intoxicating liquor.<\/li>\n<\/ul>\n<p>A BAC of below .08 provides room for rebuttal from the prosecution. If they can prove the defendant was impaired in any way, regardless of BAC, the defendant will be found guilty of the DUI charge.<\/p>\n<h3><strong>Penalties for Being Impaired to the Slightest Degree<\/strong><\/h3>\n<p>DUIs resulting from being impaired to the slightest degree can result in the same class 1 misdemeanor penalty as DUIs resulting from a BAC of .08 or higher and have <a href=\"https:\/\/rideoutlaw.com\/is-jail-mandatory-for-a-dui-conviction\/\">mandatory jail time<\/a> of at least one day.
