Arizona handles <a href=\"https:\/\/rideoutlaw.com\/endangerment-laws-in-arizona\/\">endangerment charges<\/a> broadly, and state law does not provide \u201cchild endangerment\u201d as a specific offense. Instead, child endangerment can result from committing general endangerment, <a href=\"https:\/\/rideoutlaw.com\/dangerous-crimes-against-children-a-r-s-13-705\/\">dangerous crimes against children<\/a>, or <a href=\"https:\/\/rideoutlaw.com\/child-abuse-laws-in-arizona\/\">child abuse<\/a>.<\/p>\n<p>In many cases, if a person has endangered a child, instead of being charged with endangerment, they will be charged with child abuse or dangerous crimes against children.<\/p>\n<p>What are the differences?<\/p>\n<h3><strong>Endangerment<\/strong><\/h3>\n<p>According to <a href=\"https:\/\/www.azleg.gov\/ars\/13\/01201.htm\">A.R.S. 13-1201<\/a>, \u201cendangerment\u201d is defined as \u201crecklessly endangering another person with a substantial risk of imminent death or physical injury.\u201d When it comes to children, examples include:<\/p>\n<ul>\n<li>Leaving a child alone in a vehicle in excessive heat.<\/li>\n<li>Failing to report child abuse.<\/li>\n<li>Being under the influence while caring for a child.<\/li>\n<li>Leaving a child unsupervised.<\/li>\n<\/ul>\n<p>Endangerment is a <strong><em>class 1 misdemeanor<\/em><\/strong>, which can result in 6 months of incarceration. However, it is a <strong><em>class 6 felony<\/em><\/strong> if the endangerment involved a substantial risk of imminent death, which can result in incarceration of up to 2 years.<\/p>\n<h3><strong>Child Abuse<\/strong><\/h3>\n<p>According to <a href=\"https:\/\/www.azleg.gov\/ars\/13\/03623.htm\">A.R.S. 13-3623<\/a>, child abuse occurs when a child is caused to suffer physical or emotional injury under any circumstance. This includes:<\/p>\n<ul>\n<li>Impairment of bodily function.<\/li>\n<li><\/li>\n<li>Infliction of serious emotional damage.<\/li>\n<li>Allowing someone else to inflict serious emotional damage.<\/li>\n<\/ul>\n<p>Serious emotional damage includes the child showing signs of:<\/p>\n<ul>\n<li>Severe anxiety.<\/li>\n<li><\/li>\n<li><\/li>\n<li>Untoward aggressive behavior.<\/li>\n<li>Emotional damage diagnosed by a medical doctor or psychologist.<\/li>\n<\/ul>\n<p>Child abuse results in a variety of possible felony charges, with the most severe cases resulting in <strong><em>class 2 felony<\/em><\/strong> charges. First-time offenders can be incarcerated for up to 12.5 years with such a conviction.<\/p>\n<p>Felony charges depend on the severity of the circumstances surrounding the abuse, the age of the child, and the level of recklessness or criminal negligence. Certain crimes against children under age 15 will be charged as \u201cdangerous crimes against children,\u201d which can result in even harsher penalties.<\/p>\n<h3><strong>Dangerous Crimes Against Children<\/strong><\/h3>\n<p>Arizona harshly punishes adults who commit dangerous crimes against children who are under the age of 15, pursuant to <a href=\"https:\/\/www.azleg.gov\/ars\/13\/00705.htm\">A.R.S. 13-705<\/a>.
