Criminal charges and\/or convictions can result in professional licenses being suspended, revoked, or subject to other administrative actions that impact the defendant\u2019s ability to work.<\/p>\n<p>Any individuals with a professional license that was issued by the State of Arizona will face administrative hearings before an administrative law judge, which is separate from the actual criminal court case. This generally includes professional licenses such as:<\/p>\n<ul>\n<li>Nursing licenses.<\/li>\n<li>Real estate licenses.<\/li>\n<li>Psychologist\/therapist licenses.<\/li>\n<li>Contractor licenses.<\/li>\n<li>Physician licenses.<\/li>\n<li>Pharmacy licenses.<\/li>\n<li>Teaching licenses.<\/li>\n<\/ul>\n<p>Many criminal offenses are required to be reported by the license holder or license applicant.<\/p>\n<h3><strong>Health Professionals with Criminal Charges<\/strong><\/h3>\n<p>Health professionals often face the most severe consequences for criminal charges. There are <a href=\"https:\/\/psychboard.az.gov\/sites\/default\/files\/documents\/files\/reportable%20misdemeanors_0.pdf\">many offenses<\/a> that are required to be reported, such as:<\/p>\n<ul>\n<li><a href=\"https:\/\/rideoutlaw.com\/understand-arizona-assault-laws-ars-131203\/\">Assault.<\/a><\/li>\n<li><a href=\"https:\/\/rideoutlaw.com\/kidnapping-a-r-s-13-1304\/\">Kidnapping.<\/a><\/li>\n<li><a href=\"https:\/\/rideoutlaw.com\/theft-in-arizona-a-r-s-13-1802\/\">Theft.<\/a><\/li>\n<li>Drug offenses.<\/li>\n<li><a href=\"https:\/\/rideoutlaw.com\/dui-laws-in-arizona\/\">DUI.<\/a><\/li>\n<li><a href=\"https:\/\/rideoutlaw.com\/disorderly-conduct-a-r-s-13-2904\/\">Disorderly conduct.<\/a><\/li>\n<li>Credit card fraud.<\/li>\n<li><a href=\"https:\/\/rideoutlaw.com\/indecent-exposure-a-r-s-13-1402\/\">Indecent exposure.<\/a><\/li>\n<\/ul>\n<p>According to <a href=\"https:\/\/www.azleg.gov\/ars\/32\/03208.htm\">A.R.S. 32-3208<\/a>:<\/p>\n<ul>\n<li>A <strong><em>health professional<\/em><\/strong> who has been charged with a <strong><em>misdemeanor<\/em><\/strong> involving conduct that may affect patient safety or a <strong><em>felony<\/em><\/strong> after receiving or renewing a license or certificate must notify the health professional&#8217;s regulatory board in writing within <strong><em>ten working days<\/em><\/strong> after the charge is filed.<\/li>\n<li>An <strong><em>applicant<\/em><\/strong> for licensure or certification as a health professional who has been charged with a <strong><em>misdemeanor<\/em><\/strong> involving conduct that may affect patient safety or a <strong><em>felony<\/em><\/strong> after submitting the application must notify the regulatory board in writing within <strong><em>ten working days<\/em><\/strong> after the charge is filed.<\/li>\n<li>A health professional who <strong><em>does not comply<\/em><\/strong> with the notification requirements of this section commits an act of unprofessional conduct. The health professional&#8217;s regulatory board may impose a civil penalty of not more than <strong><em>$1,000<\/em><\/strong> in addition to other disciplinary action it takes.<\/li>\n<\/ul>\n<p>In these cases, the regulatory board may conduct an investigation to determine the status of the offender\u2019s license, including its potential revocation.<\/p>\n<h3><strong>Real Estate Licenses<\/strong><\/h3>\n<p>Criminal convictions may cause an individual\u2019s real estate license to be denied or not renewed. According to the <a href=\"https:\/\/azre.gov\/faq\/reasons-denial-arizona-real-estate-license\">Arizona Department of Real Estate<\/a>:<\/p>\n<ul>\n<li>The Department shall not <strong><em>issue<\/em><\/strong> a license to a person who has been convicted of a <strong><em>felony offense<\/em><\/strong> and who is currently <strong><em>incarcerated<\/em><\/strong> for the conviction, paroled, or under community supervision and under the supervision of a parole or community supervision officer or who is on probation as a result of the conviction.<\/li>\n<li>The Department shall not <strong><em>renew<\/em><\/strong> a license of a person who has been convicted of a <strong><em>felony offense<\/em><\/strong> and who is currently <strong><em>incarcerated<\/em><\/strong> for the conviction, paroled, or under community supervision and under the supervision of a parole or community supervision officer or who is on probation as a result of the conviction.<\/li>\n<li>A licensee is prohibited from conducting activities that require a license while the licensee is <strong><em>incarcerated<\/em><\/strong>.<\/li>\n<li>A person who sets out other substantiated misrepresentations, fraudulent conduct, and certain other transgressions, including the filing of a false application, which also may be cause for the Department to deny your application.<\/li>\n<\/ul>\n<h3><strong>Teaching Licenses<\/strong><\/h3>\n<p>Professional licenses for teachers in Arizona are subject to the Arizona State Board of Education <a href=\"https:\/\/certification.azed.gov\/CodeOfEthics.html\">Code of Ethics<\/a>.
