If you\u2019ve been pulled over on suspicion of DUI in Arizona, there\u2019s a good chance the officer administered a Horizontal Gaze Nystagmus (HGN) test<\/strong>. It\u2019s one of the three standardized field sobriety tests recognized by the National Highway Traffic Safety Administration (NHTSA). But what exactly is the HGN test? What does it measure? And\u2014perhaps most importantly\u2014how reliable is it in court?<\/strong><\/p>\n

What Is the HGN Test?<\/strong><\/p>\n

The Horizontal Gaze Nystagmus test<\/strong> is a roadside sobriety test used by law enforcement to detect signs of impairment due to alcohol or certain drugs. The term “nystagmus” refers to the involuntary jerking of the eye<\/strong>. Everyone experiences nystagmus to some degree, but the movements become more exaggerated and erratic under the influence of alcohol.<\/p>\n

During the test, the officer will ask you to follow a small object\u2014often a pen or fingertip\u2014with your eyes, without moving your head. The officer then watches for involuntary eye movements as your eyes move side to side (horizontally).<\/p>\n

What Does the HGN Test Measure?<\/strong><\/p>\n

Officers administering the HGN test are looking for three specific clues in each eye<\/strong>, for a total of six clues:<\/p>\n

  1. Lack of smooth pursuit<\/strong> \u2013 The eye cannot follow the object smoothly.<\/li>\n
  2. Distinct nystagmus at maximum deviation<\/strong> \u2013 Jerking becomes obvious when the eye is held at the farthest point to one side.<\/li>\n
  3. Onset of nystagmus prior to 45 degrees<\/strong> \u2013 Jerking begins before the eye moves 45 degrees from center.<\/li>\n<\/ol>\n

    According to NHTSA guidelines, observing four or more clues<\/strong> is generally considered a failure of the test and suggests a Blood Alcohol Concentration (BAC) of 0.08% or higher<\/strong>.<\/p>\n

    Is the HGN Test Reliable?<\/strong><\/p>\n

    This is where things get complicated.<\/p>\n

    While the HGN test is scientifically validated<\/em> under controlled conditions, its reliability in the real world\u2014especially on the side of a road\u2014is hotly debated. Here are some factors to consider:<\/p>\n
