Are Gun Silencers Illegal in Arizona?
While Arizona is a state that broadly permits adults to possess firearms, this does not apply to gun silencers if the owner lacks the proper federal registration. Pursuant to A.R.S. 13-3101, any device designed, made, or adapted to muffle the report of a firearm (a silencer) is considered a prohibited weapon.
Possessing a prohibited weapon, such as a silencer, is a class 4 felony for which a first-time offender could face incarceration of up to 3.75 years. Additional charges can apply if the crime involves a prohibited possessor or for repeat offenders. Harsher penalties will be imposed if the offender used illegal firearms for purposes such as terrorism, committing a felony offense, or involvement in a criminal street gang.
Silencers that Comply with Federal Law
Despite gun silencers being classified as a prohibited weapon by state law, A.R.S. 17-251 allows for the possession of silencers for the taking of wildlife or while hunting. According to the Bureau of Alcohol, Tobacco, Firearms, and Explosives, firearm silencers are legal on a state-by-state basis for hunting only. Silencers will need to be registered through the Bureau directly.
In the News
In the spring of 2023, Arizona Governor Hobbs vetoed Senate Bill 1109 that would remove gun silencers from the list of prohibited weapons within the state of Arizona.
