Can I Legally Grow Marijuana in Arizona?
In 2020, Arizona voters passed Proposition 207, which legalized specific adult use of marijuana within the state. Laws governing the guidelines for growing marijuana in Arizona are according A.R.S. 36-2852. Per this statute, anyone wishing to grow marijuana:
- Must be at least 21 years old.
- May not have more than 12 marijuana plants within a single residence where two or more adults over age 21 live.
- Must grow the marijuana within a closet, room, greenhouse, or other enclosed area that can be locked to prevent access by minors.
- Must grow in an area where the marijuana plants cannot be seen by the public unless they are using binoculars, aircraft, or other optical aids.
Anyone who violates a law regarding the growing of marijuana can be, according to A.R.S. 36-2853, charged with:
- A petty offense for a first violation.
- A class 3 misdemeanor for the second or subsequent violation.
Class 3 misdemeanors are punishable by up to 30 days of incarceration and $500 in fines, while petty offenses can be fined up to $300.
