Arizona Dangerous Offenses
In Arizona, being charged with a “dangerous offense” can have serious consequences. According to A.R.S. 13-105, a dangerous offense is an offense “involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the intentional or knowing infliction of serious physical injury on another person.”
Further, this statute explains that a deadly weapon is any which is designed for lethal use, including a firearm. A dangerous instrument is item capable of causing serious injury or death when used for such. Serious physical injury is one which has a reasonable risk of death, causes significant or permanent disfigurement, or impairs or causes the loss of any body part or organ.
In A.R.S. 13-704, the punishment ranges for dangerous offenses are laid out. Charged as a felony, such an offense could find an individual imprisoned for as many as 35 years depending on the specific crime and felony class.
If you are convicted of a dangerous offense, your sentencing could be heavily affected. Such convictions prevent an individual both from being eligible for probation and from re-gaining their gun rights upon completing their sentence. They also have a much higher range of prison time compared to non-dangerous offenses.
Common examples of dangerous offense crimes in Arizona include aggravated assault, manslaughter, murder, attempted murder, and sexual assault.
