What You Need to Know
Facing a DUI charge in Arizona is serious—but if your blood alcohol concentration (BAC) is particularly high, you could be charged with Extreme DUI, which comes with harsher penalties and long-term consequences. At Rideout Law Group, our Arizona DUI attorneys are experienced in defending clients charged with Extreme DUI in both Maricopa County and Mohave County. Whether you’re in Scottsdale or Lake Havasu City, we’re here to protect your rights.
What Qualifies as an Extreme DUI in Arizona?
Under ARS §28-1382(A)(1), you can be charged with Extreme DUI if your BAC is 0.15% or higher within two hours of driving or being in actual physical control of a vehicle.
This is more serious than a standard DUI (which starts at 0.08%) and triggers enhanced penalties—even for first-time offenders.
Penalties for a First-Offense Extreme DUI
If convicted of a first-time Extreme DUI in Arizona, you could face:
- 30 days in jail (with at least 9 days served, the rest suspended if an ignition interlock device is installed)
- Fines and assessments totaling over $2,500
- Mandatory ignition interlock device on your vehicle for at least 12 months
- Alcohol screening, education, and treatment
- License suspension
- Community service
While these penalties are harsh, an experienced criminal defense attorney can often negotiate reduced jail time, challenge BAC results, or even get the charges dismissed.
Second-Offense Extreme DUI
If you’re convicted of Extreme DUI a second time within 7 years, the consequences become much more severe:
- 120 days in jail
- Fines over $3,000
- License revocation
- Longer ignition interlock requirement
- Possible probation or supervised monitoring
A second offense can also negatively impact your job, insurance rates, and criminal record.
Defending Against Extreme DUI Charges
At Rideout Law Group, we aggressively investigate each case to build a strong defense. Some common defense strategies include:
- Challenging the legality of the traffic stop
- Questioning the accuracy or calibration of the breathalyzer
- Disputing the timing of BAC testing
- Arguing lack of actual physical control
We understand the science behind BAC testing and have access to expert witnesses who can testify on your behalf if needed.
