Fraudulent Schemes Laws: A.R.S. 13-2310
Fraudulent schemes are those which allow the offender to benefit as a result of illegal enterprise, false pretenses, scams, or similar situations. According to A.R.S. 13-2310, this also includes a scheme or artifice to deprive a person of the intangible right of honest services.
Any person who, pursuant to a scheme or artifice to defraud, knowingly obtains any benefit by means of false or fraudulent pretenses, representations, promises, or material omissions is guilty of a class 2 felony. This can result in incarceration of up to 12.5 years.
Moreover, offenders will not be eligible for suspension of sentence, probation, pardon, or release from confinement on any basis until the sentence imposed by the court has been served, the person is eligible for release, or the sentence is commuted if either of the following applied:
- The crime allowed the offender to benefit with a value of $100,000 or more.
- The crime involved the manufacture, sale, or marketing of opioids.
While the state of Arizona does not define the specific acts which can cause an individual to be charged with fraudulent schemes and artifices, common examples include:
- Contracting without a license
- Identity theft
- Making or distributing counterfeit money, drugs, or other goods
- Fraud involving credit card, mortgage, wires, mail etc.
A situation such as the high-profile 2019 college admissions scandal, in which students were gaining admission to universities under false pretenses, is one which would be considered “honest service fraud,” depriving others of the intangible right of honest services.
